This comes after the Table View police arrested the suspect, Silindokuhle Ngcobo, more than a month after the incident.
According to court documents, the accused forced the 16-year-old to insert his penis into her vagina on 5 August.
Ngocobo made her first appearance in the Cape Town Magistrates’ Court on Monday morning, applying for legal aid and informing her lawyer that she would like to be placed in the Table View Police Station so that she could fetch her cellphone from home.
According to Ngcobo, the device contains evidence in the form of chats that could prove the allegations are false.
The court decided that the investigating officer would receive it from the accused’s sister.
Police spokesperson Wesley Twigg has confirmed that a case of rape was opened at the Table View precinct.
“A 23-year-old female suspect was arrested on Friday, September 15 and she appeared in the Cape Town Magistrate’s Court.”
The case was postponed to September 28 for bail application, and the accused remains in custody.
